Privacy Policy

This Privacy Policy describes how Auction808 (“we,” “us,” or “our”) collects, uses, and shares information about you when you use auction808.live(the “Service”).

1. Information We Collect

Information you provide

  • Account information: email address, password (hashed), and display name.
  • Producer payout information: the PayPal email address you provide so we can send payouts.
  • Listing content: beat metadata (title, genre, BPM, key, tags), cover art, master audio, and watermarked previews you upload.
  • Communications: support requests, takedown notices, and other messages you send us.

Information collected automatically

  • IP address, browser type, device identifiers, and timestamps of requests.
  • Pages viewed, auctions visited, and bids placed.
  • Standard server logs for security and abuse prevention.

Information from third parties

  • PayPal returns the payer’s name, country, and an order/transaction ID when a Buyer completes checkout, and a payout batch status when we send funds to a Producer.

2. How We Use Information

  • Operate the auction marketplace, including processing bids, payments, and payouts.
  • Authenticate accounts and protect against fraud, abuse, and unauthorized access.
  • Send service-related emails (sign-up confirmation, auction won, payout sent, password reset).
  • Comply with legal obligations and respond to lawful requests.
  • Improve the Service through aggregated analytics.

3. Legal Bases (EEA / UK Users)

Where the EU/UK GDPR applies, we process personal data under the following legal bases: (a) performance of a contract (operating the Service you signed up for), (b) compliance with legal obligations, (c) our legitimate interests in operating and securing the Service, and (d) your consent where required (for example, for non-essential analytics cookies).

4. Sharing

  • Service providers: infrastructure (Fly.io), object storage (Cloudflare R2), payment processing (PayPal), email delivery (Resend), and analytics. These providers are contractually limited to acting on our behalf.
  • Other users: your display name and the metadata you publish on a listing are visible to anyone visiting the marketplace. We never expose your email address, payment information, or PayPal address to other users.
  • Legal: we may disclose information when required to comply with valid legal process, to protect rights or safety, or to investigate fraud.
  • Business transfers: if Auction808 is acquired or merged, your information may be transferred to the successor entity, subject to this Policy.

We do not sell personal information.

5. Cookies

We use a small number of cookies and similar storage for authentication (session tokens), preferences, and aggregate analytics. You may control cookies through your browser settings; disabling them may break sign-in.

6. Retention

We retain account information for as long as your account is active. After account closure, we retain transaction and tax records as required by law (generally up to seven years) and otherwise delete or anonymize personal data within ninety (90) days.

7. Security

We use TLS for all data in transit, hash passwords with bcrypt, and gate master-audio downloads behind short-lived signed URLs. No system is perfectly secure; please use a strong, unique password.

8. International Transfers

Our infrastructure is hosted in the United States. By using the Service you consent to the transfer of your information to the United States, where data protection laws may differ from those in your country.

9. Your Rights

Depending on where you live, you may have the right to access, correct, delete, export, or restrict the processing of your personal information, and to object or withdraw consent. To exercise any of these rights, email privacy@auction808.live. We will respond within 30 days. You may also lodge a complaint with your local data protection authority.

California residents

California residents have additional rights under the CCPA, including the right to know what categories of personal information we collect and to request deletion. We do not sell personal information; the right to opt out of sale therefore does not apply.

10. Children

The Service is not directed to children under 18. We do not knowingly collect personal information from children. If you believe a child has provided us information, please contact us and we will delete it.

11. Changes

We may update this Policy from time to time. Material changes will be posted here with an updated effective date.
