DMCA Copyright Policy

Effective date: May 18, 2026

Auction808 respects the intellectual property rights of others and expects its users to do the same. We respond to notices of alleged copyright infringement that comply with the U.S. Digital Millennium Copyright Act (“DMCA”), 17 U.S.C. § 512, and we maintain a policy of terminating, in appropriate circumstances, users who are repeat infringers.

1. Filing a DMCA Takedown Notice

If you believe content on the Service infringes your copyright, send a written notice that contains all of the following to our Designated Agent (see Section 3 below). Notices missing any required element may not be actionable.

  • A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  • Identification of the copyrighted work claimed to have been infringed (or a representative list, if multiple works at a single site).
  • Identification of the material that is claimed to be infringing, with information reasonably sufficient to permit us to locate it (please include the auction URL or beat ID).
  • Information reasonably sufficient to permit us to contact you: physical address, telephone number, and email.
  • A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the owner or are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Warning:Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing may be liable for damages, including costs and attorneys’ fees.

2. Counter-Notice

If material you posted has been removed and you believe it was removed by mistake or misidentification, you may submit a counter-notice containing:

  • Your physical or electronic signature.
  • Identification of the material that was removed and the location at which it appeared before removal.
  • A statement under penalty of perjury that you have a good-faith belief that the material was removed as a result of mistake or misidentification.
  • Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the U.S. federal district court for the judicial district in which your address is located (or, if outside the United States, any judicial district in which Auction808 may be found), and that you will accept service of process from the person who provided the original notice or that person’s agent.

If we receive a valid counter-notice we will forward it to the original complainant and inform them that we may restore the material in 10 to 14 business days unless the complainant first files a court action seeking to restrain the alleged infringement.

3. Designated Agent

Auction808’s Designated Agent is registered with the U.S. Copyright Office. Postal-mail and fax details, where applicable, are available on request via the email above.

4. Repeat-Infringer Policy

Auction808 will, in appropriate circumstances, suspend or terminate the accounts of users who are determined to be repeat infringers.
